Terms of use

Last updated

The short version. Capobook is free for 20 songs. Pro is a one-time purchase, and Band plans are subscriptions you can cancel at any time. Your songs stay yours, and you're responsible for having the right to the songs you add and share. We work hard to make Capobook safe on stage, but devices fail, so keep a backup for important performances. Your consumer rights where you live always apply.

These terms

These terms are an agreement between you and an independent developer registered as a business in Israel ("Capobook", "we", "us"). They apply when you use the Capobook apps for iPhone, iPad and Android, the web app at capobook.com, set links and live sessions (together, "Capobook"). By using Capobook, you agree to them.

They work together with our privacy policy, our refund and cancellation policy and our copyright policy. If you buy through the App Store, Google Play or Paddle, their terms also apply to the purchase itself.

You can use Capobook if you're at least 13 (16 where local law says so) and, if you're under 18, your parent or guardian agrees to these terms for you. If you accept these terms for a band, church or other organisation, you confirm you may do so for it.

Your account

You don't need an account to use Capobook on one device. To sync, use a purchase in the browser or join a band, you sign in with Apple, Google or an email link.

Keep your sign-in secure, and tell us at support@capobook.com if you think someone else has used your account. You're responsible for what happens in your account, unless it happens because of our fault.

Plans, prices and payment

Free. Up to 20 songs of your own, with every feature. Demo songs don't count. Songs beyond the limit are never locked: you keep them, and deleting a song frees a place.

Pro. A one-time purchase that unlocks unlimited songs, sync through your own iCloud or Google Drive, and Capobook on iPhone, iPad, Android and the web. It's yours for as long as Capobook is offered. It is linked to your Capobook account and to the store account you bought it with.

Band. A subscription for one band, priced by the number of people in it, paid monthly or yearly. While the subscription is active, every member gets Pro. A new band can try Band free for 30 days.

Prices. The price, the billing period and what's included are shown before you buy, in your currency where the store supports it. Sales tax or VAT is included or added by the store or by Paddle, as the law in your country requires.

Subscriptions renew automatically. A Band subscription renews at the end of each period, at the price then in effect, until you cancel.

  • App Store: payment is charged to your Apple Account when you confirm the purchase, or when the free trial ends. The subscription renews unless you cancel at least 24 hours before the end of the current period, and the renewal is charged within the 24 hours before that.
  • Google Play and the web: you can cancel at any time before the renewal date and you won't be charged for the next period.

Cancelling stops the next renewal. The plan stays active until the end of the period you've paid for. If you cancel during the free trial, you aren't charged. Any unused part of a free trial ends when you buy a subscription. How to cancel, and when you can get a refund: see the refund and cancellation policy.

Price changes. If the price of a subscription goes up, we tell you in advance, as the store and the law require, and the new price applies only from your next period after the notice. You can cancel before then.

Where you buy.

  • In the iPhone and iPad app: the App Store sells the purchase.
  • In the Android app: Google Play sells the purchase.
  • On our website: Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle's buyer terms apply to those orders, and you can always write to us about one too.

Changing size. If your band grows past its size, the owner can move to a bigger size. The unused time on the current plan is credited, as the store or Paddle calculates it.

Restoring and refunds. On a new device, "Restore purchase" brings back what you bought with the same store account or Capobook account. If a purchase is refunded or reversed, what it unlocked ends. Your songs stay, and nothing beyond the free limit is deleted.

Your songs and content

You own what you bring. Songs, charts, notes, set lists, drawings and anything else you add ("your content") stay yours. We claim no ownership of them.

Most of it never reaches us. Your library lives on your devices and, if you sync, in your own iCloud or Google Drive.

What you allow us to do. When you use a feature that sends content to our servers (a band library, a set link or a live session), you give us a worldwide, non-exclusive, royalty-free licence. It lets us store, copy, transmit, format, transpose and display that content, only to run the feature for you and the people you share it with. The licence ends when the content is deleted, except for copies kept for up to 35 days in backups or where the law requires us to keep them. We don't use your content for advertising, we don't sell it, and we don't use it to train AI models.

Feedback. If you send us ideas or suggestions, we may use them freely, with no obligation to you.

Most songs, including many worship songs, are protected by copyright. Capobook is a tool for managing music you are allowed to use, and you're responsible for having the rights you need:

  • For your own use: add songs you have the right to use, such as charts you wrote, bought or were given, songs in the public domain, or charts a service lets you keep.
  • Sharing with a band, a set link or a live session makes copies for other people. That may need permission from the rights holder, or a licence that covers that exact use. Church licences, such as CCLI's, cover some copying within a church but generally not publishing lyrics on web pages anyone can open. Some chart services, such as SongSelect, also have their own rules about sharing. Follow them, and don't share charts that a licence or the site's terms forbid you to share.
  • We don't license songs and don't check who owns them. Capobook has no agreements with publishers, and nothing in Capobook gives you rights to a song.
  • Find online opens other websites inside Capobook. Those sites, and the songs on them, belong to their owners. Their terms apply to what you view and import. Import songs for your own use, as those terms allow. We don't control or endorse those sites.

If you believe content shared through Capobook infringes your rights, our copyright policy explains how to tell us. We remove infringing content when we're told about it, and we close the accounts of people who infringe repeatedly.

Using Capobook fairly

Don't use Capobook to:

  • break the law, or share content you have no right to share
  • publish set links widely (for example on public websites or social media) to distribute charts you don't have the right to distribute
  • share content that is hateful, harassing, sexually explicit involving minors, or that threatens or exposes someone's private information
  • upload malware, or try to get into accounts, bands, data or systems that aren't yours
  • overload, scrape or disrupt our servers, or get around plan limits, security or payment
  • copy, sell or resell Capobook itself, or reverse engineer it, except where the law allows this despite these terms
  • pretend to be someone else, or mislead people about who you are

Bands

  • The owner creates the band, pays for its plan, and can delete it. Admins can invite and remove people and change roles. Members can edit the band library and sets. Viewers can read and follow.
  • What a member adds to the band library belongs to the band library while the band exists. If a member leaves, the songs they added stay with the band, and anything they copied to their own songs stays with them.
  • If the band is deleted, its library and sets are deleted for everyone. Copy any songs you want to keep to your own songs first.
  • If a plan ends and isn't renewed, members can still read the band library, but editing stops until someone renews. We keep the band for 12 months, then delete it after telling the owner.
  • By joining a band, you accept that its owner and admins can remove you, change or delete what you added to the band library, and delete the band.
  • If ownership is disputed, we follow the instructions of the band's owner. The owner should hand the band to someone else before leaving.
  • Sharing the cost of a Band plan among the band is fine. Selling places in a band to people outside it isn't.
  • People in the band see each member's name and role. Choose a name you're happy for them to see.

Set links and live sessions

  • A set link is a web address that is unlisted, not private. Anyone who has it can open it and see the set and its charts, without an account, and they can forward it. You choose which sets to publish and who to send the link to. By publishing a set link, you confirm that you may share everything it shows with the people who can open it. A link stops working the day after the set's date, or 7 days after you publish it if the set has no date. You can revoke it at any time.
  • A live session code lets people follow your page turns. Anyone with the code can join as a follower, and you can see who's following and remove someone.

Other companies' services

Capobook works with services we don't run: the App Store, Google Play, Paddle, iCloud, Google Drive, Sign in with Apple, Google Sign-In, and the websites you open in Find online. Their own terms apply to them. We aren't responsible for their availability, or for the content of third-party websites.

Keeping Capobook running

We work to keep Capobook available and your library safe, and Capobook is built to work offline. We change Capobook to improve it, keep it secure or follow the law. If a change is more than minor and makes Capobook worse for you, we'll tell you clearly beforehand. You can then cancel a Band subscription and get back what you paid for the time left. For Pro, we'll offer a fair alternative or a refund where the law requires.

If we ever stop offering Capobook, we'll tell you at least 90 days before. Export will keep working until then, and we'll stop subscription renewals. We'll also help you get a refund for unused subscription time, where the store or Paddle allows it.

On stage: what we promise, and what we can't

Capobook is built never to change a song by accident and never to skip a line. Still, phones, tablets, batteries, Bluetooth pedals, networks and operating system updates can fail in ways no app controls. For important performances, keep a backup, such as a second device or a printed set.

Capobook is provided "as is" and "as available". As far as the law allows, we give no promises beyond those in these terms, including any implied promise that Capobook will meet a particular need or always work without interruption or errors.

Your statutory rights are not affected. If you are a consumer, you keep the rights your law gives you, for example to digital content that works as described.

Responsibility for loss

As far as the law allows:

  • We aren't responsible for indirect or consequential loss, lost profits or income, or lost business opportunities.
  • We aren't responsible for loss caused by something we couldn't reasonably control, such as an outage at Google or Apple, a failed device or connection, or content added by someone else.
  • Our total responsibility for any claim connected with Capobook is limited to the greater of: what you paid us for Capobook in the 12 months before the claim, or US$50.

Nothing in these terms limits our responsibility for:

  • death or personal injury caused by our negligence
  • fraud
  • damage we cause deliberately or through gross negligence
  • anything else the law doesn't allow us to limit

If you're a consumer in the EU or the UK, we're responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We aren't responsible for loss that wasn't foreseeable.

If you use Capobook for a business or organisation rather than as a consumer, you agree to cover our reasonable costs of claims by others that are caused by content you shared, or by your breaking these terms.

Suspending or closing accounts

You can stop using Capobook at any time, and you can delete your account.

We may suspend or close an account, or remove content, if:

  • someone seriously or repeatedly breaks these terms
  • they infringe copyright repeatedly
  • the law requires it
  • it's needed to protect other people or Capobook

Where we can, we warn you first and tell you why. You can reply to us to explain or disagree. If we close your account without your fault, we refund any prepaid subscription time you haven't used.

Changes to these terms

We may update these terms, for example when we add features or the law changes. If a change matters to you, we'll tell you in the app or by email at least 30 days before it takes effect. If you don't agree, you can stop using Capobook and cancel your subscription before the change applies. Changes never apply to a period you've already paid for, or to a dispute that has already started.

Law and disputes

If something goes wrong, write to support@capobook.com first. We'll try to sort it out within 30 days.

These terms are governed by the laws of the State of Israel, and the competent courts in Israel have jurisdiction.

If you're a consumer living elsewhere, you also keep the protection of your own country's mandatory consumer laws, and you can bring a claim in the courts where you live. Nothing in these terms removes your right to bring a claim as part of a group, where your law allows.

App Store terms

If you got Capobook from Apple's App Store, these terms also include the following:

  • The agreement is with us. These terms are between you and us, not Apple. We, not Apple, are responsible for Capobook and its content.
  • Licence. You may use Capobook on any Apple-branded device you own or control, as the App Store's Usage Rules allow, including through Family Sharing where it's offered. The licence can't be transferred.
  • Support. We provide support for Capobook, at support@capobook.com. Apple has no obligation to provide maintenance or support for it.
  • Warranty. If Capobook doesn't meet a warranty that applies to it, you can tell Apple, and Apple will refund the price you paid for it, if any. As far as the law allows, Apple has no other warranty obligation for Capobook. Any other claims, losses, costs or expenses caused by a failure to meet a warranty are our responsibility, within the limits of these terms.
  • Claims. We, not Apple, are responsible for any claim about Capobook by you or anyone else. This includes product liability claims, claims that Capobook fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
  • Intellectual property. If someone claims that Capobook, or your use of it, infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
  • Legal compliance. You confirm that you aren't in a country subject to a US Government embargo or designated as "terrorist supporting", and that you aren't on any US Government list of prohibited or restricted parties.
  • Contact. Questions, complaints or claims about Capobook go to: Capobook, on request, by email to support@capobook.com, support@capobook.com.
  • Other terms. You must follow any third-party terms that apply when you use Capobook, such as your mobile carrier's.
  • Apple's rights. Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple may enforce them against you.

Google Play terms

If you got Capobook from Google Play, Google Play's terms apply to your purchases there. Google isn't a party to these terms and isn't responsible for Capobook.

Everything else

  • The whole agreement. These terms, and the policies they mention, are the whole agreement between you and us about Capobook.
  • If part fails. If a court finds part of these terms invalid, the rest still applies.
  • Waiting isn't waiving. If we don't enforce a right straight away, we can still enforce it later.
  • Transfers. We may transfer this agreement to whoever takes over Capobook, and we'll tell you if that happens. You may not transfer it without our consent. This doesn't reduce your rights.
  • Notices. We send notices in the app or to the email address on your account. You can send notices to support@capobook.com.
  • Languages. These terms are also available in Hebrew. For users in Israel, if the two versions differ, the Hebrew version applies.
