Copyright policy
Last updated
The short version. Most of what people keep in Capobook stays on their own devices, where we can't see it. What we do host is what people choose to share: band libraries, set links and live sessions. If something shared there infringes your copyright or is otherwise illegal, tell us. We act quickly, tell the person who shared it, and close the accounts of repeat infringers.
What we host, and what we don't
Capobook keeps people's song libraries on their own devices and in their own iCloud or Google Drive. We don't host those libraries and can't see them. Capobook doesn't publish a song catalogue or offer songs for download either.
We do store what people choose to share through Capobook:
- Band libraries and band sets, which only that band's members can see
- Set links, web pages that anyone with the link can open, ending the day after the set's date
- Live sessions, which people following the session can see while it lasts
This policy applies to that content.
Respecting songwriters
Capobook is made for musicians, and songwriters are musicians too. Our terms of use ask everyone to add only songs they have the right to use. They also ask people to share songs only where they have permission or a licence, such as a CCLI Church Copyright License, and in the way that licence allows. Charts from licensed services, such as SongSelect, should be shared only as those services allow.
How to report infringing content
Send your notice to support@capobook.com with the subject "Copyright notice", or by post to Capobook, on request, by email to support@capobook.com. Please include:
- Your details: your name, your email address and, if you act for someone else, who that is
- The work: the song or other work you believe is infringed (for example its title, writers and publisher)
- Where it is: the exact address of the set link (it looks like
capobook.com/s/...), or, for a band library or live session, the band or session name, the song, and anything else that helps us find it - Good faith: a statement that you believe in good faith that the use isn't authorised by the copyright owner, its agent or the law
- Accuracy: a statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner of the rights or authorised to act for them
- Signature: your physical or electronic signature (typing your full name is enough)
These are the details the US Digital Millennium Copyright Act asks for. The same address takes notices under the EU Digital Services Act and Israeli law.
Reporting other illegal content
To report content that is illegal for another reason, write to the same address. Examples include hate speech, threats, or someone's private information shared without consent. Tell us where it is, why you believe it's illegal, and your name and email address. You can report anonymously, but then we can't tell you what we decided.
What happens next
- We confirm we've received your notice, and we review it promptly.
- If the content is infringing or illegal, we remove it or disable access to it. A set link can be switched off at once.
- We tell the person who shared it what we removed, why, and how to respond.
- We tell you what we decided.
We decide based on the notice and what we can see. We don't monitor shared content in general, and we never look inside people's personal libraries.
If your content was removed
If you believe your content was removed by mistake, or that you have the right to share it, reply to the message we sent you, or write to support@capobook.com with the subject "Counter-notice". Include:
- your name, email address and postal address
- what was removed, and where it was
- a statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification
- a statement that you consent to the jurisdiction of the courts where you live (or, outside the US, any court where we may be found), and that you'll accept service of process from the person who sent the notice
- your signature
We forward a valid counter-notice to the person who sent the original notice. Unless they tell us within 10 business days that they've gone to court, we may restore the content. If you live in the EU, you can also use any other way to challenge our decision that your law gives you, including the courts.
Repeat infringers
We close the accounts of people who repeatedly share infringing content.
False notices
Please don't send notices or counter-notices you know are false. Under US law, someone who knowingly misrepresents that material is infringing may have to pay the damages it causes. We may ignore notices from people who repeatedly send unfounded ones.
